Experience Administrative Law:
Mr. McGuffey’s experience in administrative law includes matters before Texas Commission on Environmental Quality (TCEQ), contested case hearings at State Office of Administrative Hearings (SOAH), contested case hearings at Railroad Commission of Texas (RRC), Public Information Act (or Open Records) matters before Office of the Attorney General of Texas, matters before the Texas General Land Office (GLO), matters before Texas Medical Board (TMB), and matters before Texas Education Agency (TEA). Mr. McGuffey has worked significantly in areas of municipal solid waste (MSW), radioactive waste, and oil and gas waste disposal permitting (including salt water disposal (SWD) wells, landfills (pits), landtreatment and landfarm facilities, and stationary treatment facilities). Mr. McGuffey has achieved favorable results in hearings representing permit applicants, nearby landowners, and citizens’ associations in contested case hearings and show cause hearings related to permitted activities.
Mr. McGuffey’s litigation experience includes lawsuits against governmental entities, environmental litigation, and oil and gas litigation. Mr. McGuffey has efficiently resolved issues for oil & gas operators and mineral owners. Recently, Mr. McGuffey second chaired a successful two-week jury trial against a governmental entity for violations of the Open Meetings Act and Public Information Act.
Mr. McGuffey’s experience in Appellate matters includes administrative appeals, interlocutory appeals, and mandamus actions. Recently, Mr. McGuffey worked to successfully defend a mandamus action, and obtain prompt dismissal of a defendant's interlocutory appeal on the eve of trial.
Mr. McGuffey also works with the firm’s legislative team to provide legal analysis. This includes analyzing statutory issues, developing strategies to further client interests, drafting proposed legislation, and reviewing filed legislation for potential effects on clients.
